Terms and Conditions
Version 3.0 — Effective May 26, 2026. By purchasing an Aurex Funded Evaluation Challenge, you acknowledge that: (1) all trading occurs in a SIMULATED environment using virtual, fictitious capital — no real money is deposited with any broker on your behalf; (2) the purchase of an Evaluation Challenge is a SERVICE FEE for access to our evaluation software, not a deposit or investment; (3) Reward Certificates are contractual performance acknowledgments — not financial instruments or securities; (4) past performance in simulated environments does not guarantee future results in live markets.
Section 1 — General Provisions and Acceptance of Terms
These Terms and Conditions ("Agreement", "T&C", or "Terms") constitute a legally binding agreement between you ("Participant", "Trader", "User") and Aurex Funded ("Company", "we", "us", "our") governing your access to and use of the Aurex Funded Trading Evaluation Program and all related services, platforms, and digital tools. By registering, purchasing an Evaluation Challenge, or accessing any portion of our platform, you confirm that you have read, understood, and agree to be legally bound by this Agreement in its entirety. If you do not agree, you must immediately discontinue use of our services. This Agreement applies to all programs (PRO, FLEX, RAPID) and to all associated digital platforms, dashboards, educational resources, and community features. If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
Section 2 — Definitions
"Evaluation Challenge" — a paid performance assessment conducted entirely in a simulated trading environment. "PRO Challenge" — two-phase evaluation with static drawdown, no consistency rule in funded stage, and no time limit. "FLEX Challenge" — single-phase evaluation with EOD trailing drawdown, 60% daily consistency rule, overnight positions allowed, and no time limit. "RAPID Challenge" — single-phase speed evaluation with EOD trailing drawdown, 60% consistency rule, 5-trading-day maximum, and one (1) permitted reset. "Simulated Account" — a virtual trading account using fictitious capital. "Virtual Capital" — fictitious USD funds with no monetary value. "Reward Certificate" — performance-based document issued upon successful completion of an Evaluation Challenge; not a security or investment product. "EOD Trailing Drawdown" — drawdown floor adjusts upward only at end-of-day equity highs. "Static Drawdown" — fixed drawdown calculated from the original starting balance. "Consistency Rule" — no single trading day may account for more than 60% of total net profit in any payout cycle (FLEX and RAPID). "Maximum Daily Loss (MDL)" — maximum permissible loss within a single trading day, calculated from opening equity. "Trading Day" — any calendar day on which at least one trade is opened and closed.
Section 3 — Nature of the Service — Simulated Trading Environment
All trading activity occurs in a fully simulated, non-live environment using Virtual Capital with no real monetary value. Aurex Funded is not a licensed broker-dealer, futures commission merchant, securities dealer, or any other regulated financial institution. Nothing in this Agreement establishes a brokerage account, investment account, or regulated financial relationship. The fee paid to access an Evaluation Challenge is strictly a service fee for the use of our evaluation software and platform — it is not a deposit, is not invested in financial markets, and does not represent a contribution of capital to Aurex Funded.
Section 4 — Eligibility Requirements
You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction (whichever is greater). Aurex Funded services are not available to individuals residing in or nationals of countries subject to comprehensive international sanctions (OFAC, UN Security Council, EU, UK HM Treasury). Participants may purchase any number of Evaluation Challenges, however a hard cap of $100,000 USD in total simultaneous funded capital applies — for example two (2) $50,000 funded accounts, but never exceeding $100,000 in total funded capital. Within that cap, the Scaling Program (Section 12) allows scaling a single funded account up to $500,000 USD virtual ceiling. You must provide accurate information and ensure participation is lawful in your jurisdiction.
Section 5 — Evaluation Challenge Programs — Structure and Rules
Aurex Funded offers three programs, all conducted exclusively on Simulated Accounts: PRO — two-phase classical evaluation, static drawdown, no time limit, no consistency rule in funded stage, overnight positions allowed (no weekend holding); FLEX — single-phase, EOD trailing drawdown, no time limit, overnight and weekend holding not allowed; RAPID — single-phase speed challenge, 5-trading-day maximum, one reset permitted, overnight and weekend holding not allowed. Available account sizes: $10,000 — $25,000 — $50,000 — $100,000.
5.3 Full program parameters:
- Profit target — PRO: 9% Phase 1 + 4% Phase 2; FLEX: 6%; RAPID: 5%.
- Max daily loss — PRO: 4%; FLEX: 2%; RAPID: 2%.
- Max total drawdown — PRO: 9% static; FLEX: 4% EOD trailing; RAPID: 3% EOD trailing.
- Consistency rule — None on PRO; 60% max/day on FLEX and RAPID.
- Min trading days — PRO: 5; FLEX: 7; RAPID: none.
- Time limit — PRO and FLEX: none; RAPID: 5 trading days.
- Overnight positions — PRO: allowed; FLEX and RAPID: not allowed (3-warning system per overnight breach).
- Weekend holding — Not allowed on any program (soft breach, maximum 2 strikes).
- News trading — Not allowed within ±2 minutes of high-impact releases on any program (soft breach, maximum 2 strikes).
- Leverage — 1:100 on all programs.
- Profit split — PRO: 70% first / 80% after; FLEX and RAPID: 80%.
- Fees — $10K: $62 (PRO) / $72 (FLEX) / $34 (RAPID); $25K: $132 / $162 / $94; $50K: $220 / $262 / $164; $100K: $410 / $462 / $314.
- Reset — RAPID only: 1 reset allowed. Reset fees are non-refundable.
- Evaluation fee — Not refundable upon obtaining a funded account. See Section 13.
Section 6 — Risk Management Rules by Program
Maximum Daily Loss applies to both evaluation and funded stages: PRO 4%, FLEX 2%, RAPID 2%. Both realized and unrealized losses on open positions count toward the MDL, calculated from opening equity each trading day. Maximum Total Drawdown during evaluation: PRO 9% static; FLEX 4% EOD trailing; RAPID 3% EOD trailing. During the funded stage: PRO Funded 8% static; FLEX Funded 5% EOD trailing; RAPID Funded 3% EOD trailing. For EOD trailing, the floor moves upward only at confirmed end-of-day equity highs — intraday unrealized gains do not move it. For PRO static, the floor is anchored to the starting balance for the full duration. The 60% Consistency Rule applies to FLEX and RAPID in both stages; PRO Funded is exempt. Overnight positions: PRO allowed; FLEX and RAPID not allowed — an overnight breach on FLEX or RAPID is a soft breach (it does not close the account) and a 3-warning system applies, after which the account is terminated. Weekend holding is not allowed on any program; it is a soft breach with a maximum of 2 strikes on every account type, and the third breach terminates the account. The same 2-strike limit applies to news trading breaches. Leverage is capped at 1:100 across all programs.
Section 7 — Funded Account Rules
PRO Funded: 8% static drawdown, 70% / 80% profit split, payout every 14 days, minimum 1% balance profit, maximum 10 withdrawals, 30-day max inactivity, overnight allowed, weekend holding not allowed. FLEX Funded: 5% EOD trailing, 80% profit split, 60% consistency rule, no overnight, no weekend holding (3-warning system per overnight breach), payout every 14 days, maximum 5 withdrawals, 30-day max inactivity. RAPID Funded:3% EOD trailing, 80% profit split, 60% consistency rule, no overnight, no weekend holding (3-warning system per overnight breach), payout every 7 days, maximum 5 withdrawals, 20-day max inactivity. Processing time: 24–48 hours.
Section 8 — Prohibited Trading Practices
Violation of any Prohibited Trading Practice will result in immediate account termination, forfeiture of accrued virtual profits, and disqualification from Reward Certificate issuance. No refund will be issued. Prohibited: Expert Advisors (EAs), automated bots and any algorithmic execution; copy trading, signal services and mirror trading; cross-account hedging between Aurex Funded accounts or with any external broker; news trading — opening or closing positions within two (2) minutes before or after a high-impact economic event (Section 9); Martingale strategies; grid trading; HFT and latency arbitrage; account sharing or third-party trading; gambling behavior — oversized positions, disproportionate lot sizes, passing an evaluation with a single trade, or any non-genuine trading conduct designed to exploit the simulation rather than demonstrate real skill.
Section 9 — News Event Restrictions
Opening or closing positions is prohibited within two (2) minutes before and two (2) minutes after the scheduled release of any high-impact macroeconomic event. Designated events include Non-Farm Payrolls (NFP), CPI and Core CPI, FOMC decisions and minutes, GDP releases, and central bank interest rate decisions (Fed, ECB, BOE, BOJ, etc.), plus any event marked High Impact on the Aurex Funded dashboard economic calendar. It is your sole responsibility to monitor the calendar. A news breach is a soft breach with a maximum of 2 strikes on all account types; the third breach terminates the account.
Section 10 — Platform and Technology
Aurex Funded currently provides Simulated Account access exclusively through TradeLocker. MetaTrader 4 and MetaTrader 5 are not currently available. EAs and algorithmic systems are prohibited regardless of TradeLocker's technical capabilities (Section 8.1). We make reasonable efforts to maintain platform availability but do not guarantee uninterrupted access; simulated price feeds approximate but may not be identical to any live brokerage.
Section 11 — Reward Certificates
Reward Certificates are NOT securities, financial instruments, derivatives, investment products, or any form of negotiable instrument. They cannot be traded, transferred, sold, pledged, or assigned. Eligibility requires: successful completion of all evaluation phases, no rule violations, minimum trading days accumulated, profit target achieved, minimum 1% net profit in the current funded payout cycle, consistency rule complied with (FLEX/RAPID), and request submitted via dashboard. Profit split: PRO 70% first / 80% after; FLEX and RAPID 80%. Payout frequency: PRO and FLEX every 14 days; RAPID every 7 days. Processing time: 24–48 business hours. Maximum withdrawals per funded account: PRO 10; FLEX 5; RAPID 5. The original Evaluation Challenge fee is a service fee for access to the evaluation and is not refunded upon issuance of Reward Certificates or upon obtaining a funded account.
Section 12 — Scaling Program
Every five (5) months, funded Participants may request a manual review for a possible increase of their simulated account limit, based on performance. To be eligible during that period the Participant must maintain consistent performance, not lose the account, and complete at least four (4) withdrawals (minimum one per month). If approved, a $100,000 simulated account may be increased to $150,000 or $200,000 depending on performance, and after each further 5-month period of continued compliance the Participant may request an additional increase, up to a maximum ceiling of $500,000 USD within that single account. The Scaling Plan increases one existing funded account — it does not allow exceeding the $100,000 simultaneous funded cap by accumulating accounts. Scaling criteria may be modified with thirty (30) days' notice.
Section 13 — Fees, Payments, and Refund Policy
Challenge fees are as displayed on the website at time of purchase, denominated in USD. The challenge fee grants access only to the evaluation on a Simulated Account and is not a deposit, trading capital, or a fee that is refunded when a funded account is obtained. No refunds apply under any circumstances — every purchase is final, as the Participant is acquiring an evaluation within a simulated funding program. RAPID reset fees: $10,000: $29; $25,000: $49; $50,000: $69; $100,000: $100 — non-refundable regardless of outcome. Initiating a payment chargeback without first seeking resolution through support constitutes a material breach and results in immediate permanent ban. You are solely responsible for all applicable taxes; Aurex Funded does not provide tax advice.
Section 14 — Intellectual Property
All content, software, trademarks, logos, evaluation methodologies, and other intellectual property on the Aurex Funded platform are the exclusive property of Aurex Funded or its licensors. Aurex Funded does not claim ownership over trading strategies independently developed by Participants but reserves the right to analyze trading data for evaluation, risk management, fraud detection, and platform improvement.
Section 15 — Account Termination and Suspension
Aurex Funded may immediately terminate any account, without notice and without refund, upon: breach of MDL or Max Total Drawdown; violation of any Prohibited Trading Practice or news event restriction; provision of false information; account sharing or third-party trading; cross-account hedging; initiation of a payment chargeback; exceeding the $100,000 simultaneous funded capital cap; extended inactivity; or any conduct reasonably determined to be abusive or fraudulent. Upon termination, all access is revoked and virtual balances are forfeited. Sections 3, 13, 14, 17, and 18 survive termination.
Section 16 — Amendments to Terms
Aurex Funded reserves the right to modify these Terms at any time. Material changes will be communicated via website posting, email, or dashboard notice. Changes will not apply retroactively to Evaluation Challenges already in progress, except where required by law or to address fraud. Continued use after amendments constitutes acceptance.
Section 17 — Disclaimers and Limitation of Liability
Nothing within the Aurex Funded platform constitutes financial or investment advice. Performance in simulated trading does not guarantee or predict performance in live trading. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUREX FUNDED AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. AUREX FUNDED'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL CHALLENGE FEES PAID BY THE PARTICIPANT IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM. You agree to indemnify, defend, and hold harmless Aurex Funded and its agents from claims arising from your breach of these Terms or your use of the platform in violation of applicable law.
Section 18 — Governing Law, Liability Waiver, and Dispute Resolution
BY PURCHASING ANY EVALUATION CHALLENGE OR ACCESSING THE AUREX FUNDED PLATFORM, YOU EXPRESSLY, KNOWINGLY, AND VOLUNTARILY WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM, LAWSUIT, OR LEGAL PROCEEDING OF ANY KIND AGAINST AUREX FUNDED OR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR REPRESENTATIVES IN ANY COURT OF LAW OR EQUITY, IN ANY JURISDICTION, ANYWHERE IN THE WORLD.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Aurex Funded is incorporated. By accepting these Terms you irrevocably waive, release, and discharge Aurex Funded and all Released Parties from any and all claims arising out of your participation in any Aurex Funded program, including any Reward Certificate or denial thereof, any account termination or modification, and any simulated trading results. You also irrevocably waive your right to a trial by jury and your right to bring or participate in any class action, collective action, consolidated proceeding, or representative action. Your sole and exclusive remedy is to submit a written description of your concern to legal@aurexfunded.com; Aurex Funded will respond within thirty (30) calendar days. You acknowledge that these waivers are knowing, voluntary, and a material inducement for Aurex Funded to provide access to its platform.
Section 19 — Miscellaneous Provisions
This Agreement, together with the product specifications applicable to the Evaluation Challenge purchased, constitutes the entire agreement between the parties. Failure to enforce any provision shall not be deemed a waiver. You may not assign your rights without our prior written consent. This Agreement is written in English; in the event of conflict between language versions, the English version prevails. Aurex Funded is not liable for failures caused by circumstances beyond its reasonable control (force majeure).
